These Terms & Conditions ("Terms") form a legally binding agreement between you and HRV Enterprises INC LLC ("MyGradStoles," "we," "us," or "our") governing your use of mygradstoles.com and any order you place for our products: Graduation Stoles, Religious Stoles, Custom Graduation Stoles, and Blank Graduation Stoles.

By using this site or placing an order, you accept these Terms

Simply browsing mygradstoles.com, creating an account, or placing an order constitutes your acceptance of these Terms in full, including the arbitration provision in Section 17 (subject to your opt-out right described there). If you do not agree, please do not use the site or place an order.

Section 02

Eligibility & Age Requirements

  • You must be at least 18 years old, or the age of majority in your province of residence in Canada, to place an order and enter into a binding contract with us.
  • Visitors and browsers as young as 13 may use the informational parts of the site, consistent with the Children's Online Privacy Protection Act (COPPA), but any order must be placed by a parent, guardian, or other adult (18+) acting on the minor's behalf, such as a parent ordering a graduation stole for their teenager.
  • We do not knowingly collect personal information directly from children under 13 without parental consent; see our Privacy Policy for details.
  • By placing an order, you represent that you meet these age requirements and have the legal capacity to enter into this agreement.
Section 03

Accounts

  • You may check out as a guest or create a MyGradStoles account to track orders and save information for future purchases.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • Provide accurate, current information when creating an account, and notify us promptly at contact@mygradstoles.com if you suspect unauthorized use of your account.
  • We may suspend or terminate an account that violates these Terms, including the repeat-infringer policy in our Copyright & Trademark Policy.
Section 04

Products We Sell

MyGradStoles manufactures and sells Graduation Stoles, Religious Stoles, Custom Graduation Stoles, and Blank Graduation Stoles, manufactured at our facility in India and shipped exclusively to customers in the United States and Canada. We are a direct seller/manufacturer, not a third-party marketplace connecting independent buyers and sellers.

Section 05

Order Process: Offer, Acceptance & Our Right to Refuse

Your Order Is an Offer

Placing an order and submitting payment is your offer to purchase, not an automatic contract. Product listings on our site are an invitation to make an offer, not a binding offer from us.

Our Acceptance

We accept your offer, forming a binding contract, when we send an order confirmation email — or, for custom items, when production begins following your approved digital proof.

We may refuse or cancel any order

We reserve the right to refuse, limit, or cancel any order for reasons including but not limited to: suspected fraud, pricing or listing errors, product unavailability, a design that violates Section 12 (Prohibited Content), or a shipping address we cannot reasonably serve. If we cancel an order after payment, you will receive a full refund of amounts charged for that order.

Section 06

Pricing, Currency & Tax

  • All prices displayed on mygradstoles.com are in U.S. Dollars (USD), regardless of whether you are shipping to the United States or Canada.
  • Applicable sales tax is calculated and added at checkout based on your shipping address; it is not included in the listed product price. Any customs duties or import taxes assessed at delivery are separate still — see our Shipping Policy, Sections 9-10.
  • We make reasonable efforts to ensure pricing accuracy; if a pricing error occurs, we will contact you before processing your order to confirm the correct price or cancel with a full refund.
  • Prices are subject to change without notice, but changes do not affect orders already confirmed.
Section 07

Custom & Personalized Orders

Custom Graduation Stoles and Religious Stoles are governed in full detail by our separate Custom & Personalized Order Policy, which is incorporated into these Terms by reference. In summary:

  • Every custom order includes a free digital proof, and production does not begin until you give written approval.
  • Spelling, dates, names, and other text accuracy is your responsibility to confirm at the proof stage; errors you approved are not eligible for free correction.
  • Once you approve a proof and production begins, the order cannot be cancelled, returned, or refunded for a change of mind, since it is manufactured specifically to your specifications.
  • The one exception is our own error — if the finished item does not match your approved proof or is defective, you are fully covered for a free replacement or refund.
Section 08

Shipping & Delivery

Every order is manufactured in India and shipped internationally to the United States or Canada. Production time, shipping speeds, costs, customs/duty responsibility, and delivery estimates are set out in full in our Shipping Policy, which is incorporated into these Terms by reference.

Section 09

Returns, Refunds & Warranty

Our Returns & Refund Policy, incorporated by reference into these Terms, governs eligibility windows, the claims process for damaged or defective items, and refund timelines. Where that policy or our Custom & Personalized Order Policy provides an express warranty or remedy, that express warranty is the extent of our obligation, as described further in Section 13.

Section 10

Intellectual Property — Our Content

All original content on mygradstoles.com — product photography, stole designs we originate, page layouts, text, and the MyGradStoles name and logo — is owned by HRV Enterprises INC LLC and protected by U.S. and Canadian copyright and trademark law. You may view and share pages for personal, non-commercial purposes, but may not copy our content for use in another business without our written permission. Full detail is in our Copyright & Trademark Policy.

Section 11

Intellectual Property — Your Uploads

You warrant you have the right to any logo, crest, or text you submit

By submitting a school crest, Greek letters, mascot, religious symbol, name, or any other image or text for a Custom Graduation Stole or Religious Stole, you represent and warrant that you own it or otherwise have the legal right and license to have it commercially reproduced on a physical product. You grant us a limited, non-exclusive license to reproduce that content solely to manufacture and proof your order. We do not independently verify the ownership or licensing status of content you submit.

The full terms of this warranty, our production license, our DMCA notice-and-takedown process, and related provisions are set out in our Copyright & Trademark Policy, which is incorporated into these Terms by reference.

Section 12

Prohibited Content & Conduct

You may not use mygradstoles.com, or submit a design for personalization, that:

  • Contains hate speech or imagery demeaning a person or group based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or age
  • Infringes a copyright, trademark, or other intellectual-property right, including unauthorized use of a school, brand, or organization's marks (see our Copyright & Trademark Policy)
  • Is sexually explicit, obscene, threatening, or promotes violence or self-harm
  • Violates any applicable U.S. or Canadian federal, state, provincial, or local law
  • Attempts to interfere with, disrupt, or gain unauthorized access to our website or systems

We may refuse, cancel, or modify any order containing prohibited content, and may suspend or terminate accounts of repeat violators, consistent with Section 3 and our Copyright & Trademark Policy.

Section 13

Disclaimer of Warranties ("As-Is")

Except as expressly stated, our site and products are provided "as-is"

To the fullest extent permitted by law, mygradstoles.com and our products are provided on an "as-is" and "as-available" basis, without warranties of any kind, express or implied, except for: (a) the express remedies described in our Returns & Refund Policy and Custom & Personalized Order Policy for manufacturing errors and defects; and (b) any implied warranty of merchantability or fitness for a particular purpose that cannot be lawfully disclaimed under applicable U.S. state or Canadian provincial law (see Sections 18-19). Some states and provinces do not allow the exclusion of certain implied warranties, so some exclusions in this Section may not apply to you.

Section 14

Limitation of Liability

To the maximum extent permitted by applicable law, HRV Enterprises INC LLC's total liability arising out of or related to your order or use of mygradstoles.com is limited to the amount you paid for the specific product giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages — including lost event costs, lost wages, or emotional distress related to a delayed or imperfect stole — even if we were advised of the possibility of such damages.

Exceptions preserved by law

Nothing in these Terms limits liability where such limitation is prohibited by law, including liability for our own fraud, willful misconduct, or gross negligence, or for a consumer's non-waivable statutory rights under applicable U.S. state or Canadian provincial consumer protection law.

Section 15

Indemnification

You agree to defend, indemnify, and hold harmless HRV Enterprises INC LLC, its officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) content you submit for a custom order, including any copyright, trademark, or right-of-publicity infringement claim (as further detailed in our Copyright & Trademark Policy, Section 5); or (c) your violation of any applicable law or the rights of a third party.

Section 16

Governing Law

These Terms, and any dispute arising out of or relating to them or your use of mygradstoles.com, are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws principles — except where a mandatory consumer-protection law of your own U.S. state or Canadian province requires the application of your local law for that specific issue, in which case your local law governs on that issue only (see Sections 18–19).

Section 17

Dispute Resolution, Arbitration & Class-Action Waiver

Arbitration clauses and class-action waivers are a significant limitation on legal rights, are subject to strict enforceability requirements that vary by jurisdiction, and are treated very differently across the U.S. states and Canadian provinces this business serves (see the carve-out below for Québec and Ontario). This draft is a reasonable starting point, not a substitute for review by a licensed attorney qualified in Illinois consumer and arbitration law before you rely on it.

17.1 — Informal Resolution First

Before filing a claim, you agree to first contact us at contact@mygradstoles.com and attempt in good faith to resolve the dispute informally for at least 30 days.

17.2 — Binding Arbitration (U.S. Customers)

If informal resolution fails, you and MyGradStoles agree that any dispute arising out of or relating to these Terms or your order will be resolved by binding, individual arbitration administered by a recognized arbitration provider (such as the American Arbitration Association) under its consumer arbitration rules then in effect, rather than in court, except that either party may bring an individual claim in small-claims court if it qualifies. This arbitration agreement is governed by the Federal Arbitration Act.

17.3 — Your Right to Opt Out

You can decline arbitration

You may opt out of this arbitration agreement by sending written notice to contact@mygradstoles.com within 30 days of your first order or account creation, stating your name, order number (if any), and a clear statement that you opt out of arbitration. If you opt out, disputes will be resolved in the state or federal courts located in Cook County, Illinois, and you and we both consent to personal jurisdiction there.

17.4 — Class-Action Waiver

To the extent permitted by law, you and MyGradStoles agree that any arbitration or court proceeding will be conducted only on an individual basis, and not as part of a class, consolidated, or representative action.

Not enforceable against Canadian consumers in several provinces

Mandatory pre-dispute arbitration clauses and class-action waivers in consumer contracts are void or unenforceable in Québec (Consumer Protection Act, CQLR c. P-40.1, s. 11.1) and restricted in Ontario (Consumer Protection Act, 2002, s. 7-8) and potentially other provinces. For customers in those provinces, this Section 17 does not apply to the extent it would violate applicable provincial consumer protection law, and such disputes may instead be brought before the courts of competent jurisdiction in your province, or through any other dispute process required by your provincial law.

U.S. State Law Notices

Nothing in these Terms is intended to reduce the non-waivable consumer protections available to you under your own state's law, including implied warranty protections and UDAP statutes. Use the search box to find your state's core consumer protection statute, referenced throughout our policies.

Section 19

Canadian Consumer Rights

Canadian customers are protected by the federal Competition Act, and by the consumer protection statute of their own province or territory, several of which impose specific disclosure requirements for distance/internet sales and recognize a custom-goods exception to general cancellation rights once production has begun, consistent with Section 7 above and our Custom & Personalized Order Policy. Québec customers may additionally request key documents, including these Terms, in French by contacting contact@mygradstoles.com, consistent with Québec's Charter of the French Language.

Section 20

Severability, Entire Agreement & Waiver

Severability

If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Custom & Personalized Order Policy, Returns & Refund Policy, Shipping Policy, Privacy Policy, Cookie Policy, and Copyright & Trademark Policy, constitute the entire agreement between you and MyGradStoles regarding your use of the site and orders, superseding any prior agreements on the same subject.

No Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, products, or applicable law. The "Last Updated" date at the top of this page reflects the most recent revision. Material changes will be flagged on this page, and continued use of the site after changes take effect constitutes acceptance of the revised Terms; changes do not retroactively apply to an order already confirmed at the time of purchase.
